1. Acceptance of These Terms

By downloading, installing, accessing, or using the hearOS mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, incorporated by reference.

If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and ICI Tech Teknoloji A.Ş. ("Company", "we", "us", or "our"), a company registered in Turkey.


2. Definitions

3. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Be capable of forming a legally binding contract
  • Not be prohibited from using the Service under applicable law

An account is required to use hearOS. There is no guest or offline mode. By creating an account, you represent that you meet these requirements. If we learn a user is under 18, we will terminate the account and delete the data.


4. Account Registration

An account is required to access the Service. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account information up to date
  • Maintain the confidentiality of your password and not share it with others
  • Notify us at app@icitech.com.tr if you suspect unauthorized account access
  • Accept responsibility for all activity under your account

Each person may maintain only one account. Creating multiple accounts to circumvent a suspension, abuse free trial benefits, or for any other reason is prohibited.


5. Free Trial

We may offer a free trial of hearOS Premium. The following terms apply:

  • Free trials are available to new subscribers only — users who have not previously held a hearOS Premium subscription on the same Apple ID or Google account.
  • One free trial per person. Creating multiple accounts to access additional trials is prohibited.
  • The Trial Period length will be clearly stated before you start.
  • You may be required to provide a valid payment method to activate a trial.
  • Your payment method will not be charged during the trial.
  • Automatic conversion: At the end of the Trial Period, your subscription will automatically convert to a paid subscription at the applicable rate, unless you cancel before the trial ends.

Important: Deleting the app, logging out, or contacting us does not cancel your trial. Cancel through the App Store or Google Play.

6. Subscriptions and Billing

hearOS Premium is an auto-renewing subscription through the Apple App Store (iOS) or Google Play (Android).

  • Subscription fees are billed in advance on a recurring basis (monthly or annually).
  • Your subscription renews automatically at the end of each period unless cancelled.
  • The renewal charge applies within 24 hours before the end of the current period.
  • We do not process payments directly and never receive your card details.
  • We use RevenueCat to manage subscription state only — see Section 16.
  • Prices may vary by region; applicable taxes are determined and collected by Apple or Google.

7. Cancellation and Refunds

Cancellation takes effect at the end of the current paid billing period. You retain Premium access until that date.

Refunds

All refund requests must be submitted to Apple or Google directly:

EEA and UK consumers may have additional statutory refund and withdrawal rights — see Section 22.


8. The Service — What hearOS Is and Is Not

What hearOS is

hearOS is a consumer wellness and self-management support tool designed to help you:

  • Identify your estimated tinnitus frequency through guided matching
  • Build personalized daily sound therapy routines
  • Track symptoms, relief scores, and progress over time
  • Monitor ambient noise levels in your environment
  • Wind down and relax with guided sleep and calm sessions

What hearOS is not

hearOS is not any of the following:

  • A medical device or regulated health application
  • A clinical audiological tool or audiogram
  • A telehealth or therapy platform
  • A substitute for professional ENT, audiologist, or clinical care
  • A guarantee of any health or symptom-management outcome

The content, routines, frequency profiles, symptom trends, and relief scores within hearOS are general informational and motivational aids. They are not personalized medical advice.


9. Medical and Safety Disclaimer

Please read this section carefully.

Not a medical service

hearOS does not provide medical advice, diagnosis, or treatment. Nothing in the Service constitutes or replaces professional medical, audiological, ENT, or clinical advice. The hearing self-check is inspired by common screening formats for personal awareness only — it is not a diagnostic audiogram and does not replace a clinical hearing assessment.

Always seek the advice of a qualified health professional for any medical condition, hearing concern, or tinnitus management plan. Never disregard or delay seeking professional advice because of something you read or experienced in hearOS.

Hearing safety

Do not use hearOS at unsafe volume levels. Prolonged exposure to loud sound can cause or worsen hearing damage. We recommend using hearOS at comfortable volumes through safe listening practices. The app includes volume guidance but cannot override your device's volume settings.

Limitation of liability for health outcomes

To the maximum extent permitted by applicable law, we are not liable for any health outcomes, hearing changes, or other consequences arising from your use of or reliance on the Service. See Section 19.


10. Microphone Use

hearOS uses your device's microphone solely for real-time ambient noise level monitoring. When you grant microphone permission:

  • The app measures the ambient sound level in your environment and displays it on-screen.
  • Audio is never recorded, stored, or transmitted to our servers or any third party.
  • Microphone access can be revoked at any time through your device settings (iOS: Settings → Privacy & Security → Microphone; Android: Settings → Apps → hearOS → Permissions → Microphone). Revoking microphone access will disable the environment noise monitoring feature only; all other features remain available.

11. Acceptable Use

You agree to use the Service only for lawful personal, non-commercial wellness support purposes and in accordance with these Terms.


12. Prohibited Conduct

You agree not to:

  • Use the Service if you are under 18 or impersonate another person
  • Reverse engineer, decompile, or attempt to derive source code of the Service
  • Use automated tools, bots, or scrapers to extract data from the Service
  • Introduce malware or interfere with the Service's infrastructure
  • Resell, sublicense, or commercially exploit the Service
  • Create multiple accounts to abuse free trial benefits
  • Use the Service in violation of applicable law

13. Intellectual Property

The Service and all Company Content — including the hearOS name and logo, app design, feature concepts (tinnitus frequency matching, Relief Studio, symptom diary, hearing self-check), software, audio content, and text — are owned by or licensed to ICI Tech Teknoloji A.Ş.

You receive only a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

Feedback: Any feedback you submit grants us a perpetual, royalty-free licence to use it without obligation or compensation.


14. Your Content and Data

You retain ownership of the content you create in hearOS — including symptom diary entries, goals, and session notes. You grant us a limited licence to store and process this content solely to provide the Service to you.

You are responsible for your content. We are not responsible for data loss resulting from device failure, account deletion, or events outside our control.


15. Privacy

Your use is governed by our Privacy Policy and, for EEA/UK users, our GDPR Privacy Notice, both incorporated by reference.

Key commitments:

  • We do not sell your data.
  • We do not share tinnitus, hearing, or symptom data with advertising platforms.
  • Microphone audio is never recorded or transmitted.

16. Third-Party Services and Platforms

Apple App Store (iOS)

  • These Terms are between you and ICI Tech Teknoloji A.Ş. only — not Apple.
  • Apple has no obligation to provide maintenance or support for hearOS.
  • Apple is not responsible for any product claims relating to hearOS.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play (Android)

Your use of Google Play is governed by Google's Terms of Service. Google Play is not a party to these Terms.

RevenueCat

We use RevenueCat to manage subscription state. RevenueCat receives only a pseudonymous customer ID and subscription status — not your health data or payment details. RevenueCat privacy policy: https://www.revenuecat.com/privacy


17. Availability, Updates, and Changes to the Service

  • We aim for continuous availability but do not guarantee uninterrupted access.
  • The Service requires an internet connection for all features.
  • We may modify, suspend, or discontinue any part of the Service with reasonable notice.
  • We are not liable for any interruption, modification, or discontinuation.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, including:

  • Fitness for any particular purpose, including tinnitus relief or hearing improvement
  • Accuracy or completeness of tinnitus frequency profiles, hearing self-check results, or symptom trends
  • Uninterrupted or error-free operation
  • Any health, audiological, or wellness outcome

19. Limitation of Liability

To the maximum extent permitted by applicable Turkish law, ICI Tech Teknoloji A.Ş. and its directors, employees, and partners shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Health outcomes, hearing changes, or symptom changes arising from use of the Service
  • Loss of data, revenue, or goodwill
  • Any damages exceeding the greater of (a) the amount paid to us in the twelve months preceding the claim, or (b) ₺500

Nothing limits our liability for death or personal injury caused by gross negligence, fraud, or any liability that cannot be excluded under mandatory Turkish law.


20. Indemnification

You agree to indemnify ICI Tech Teknoloji A.Ş. against claims arising from your violation of these Terms, applicable law, or your misrepresentation of eligibility or identity.


21. Termination

By you

Delete your account via Settings → Account → Delete Account. This does not automatically cancel an active subscription — cancel separately via the App Store or Google Play first.

By us

We may suspend or terminate your account for breach of these Terms, legal requirements, or to protect users or the Service.

Effect

Your licence ends immediately. We delete your data per our Privacy Policy retention schedules. Sections 9, 13, 18, 19, 20, and 22 survive termination.


22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey, including the Turkish Code of Obligations, the Law on Consumer Protection No. 6502, and the Electronic Commerce Law No. 6563.

Disputes shall be submitted to the exclusive jurisdiction of the courts and enforcement offices of Istanbul (Çağlayan), Turkey, subject to mandatory consumer rights below.

EEA and UK consumers: You retain the protections of the mandatory consumer protection laws of your country of residence, including the right to apply to your national consumer protection authority. These cannot be waived by these Terms.


23. Changes to These Terms

For material changes, we will notify you at least 14 days in advance via in-app notice or email. The current version is at https://hearos.app/en/terms/.


24. Miscellaneous

  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us.
  • Severability: Invalid provisions are modified to minimum extent; remaining provisions continue in full force.
  • Waiver: Non-enforcement of any provision is not a waiver.
  • Assignment: You may not assign your rights without our written consent. We may assign ours without restriction.
  • Force majeure: We are not liable for delays caused by events beyond our reasonable control.
  • Language: English version prevails over any translation.
